End User License Agreement
This End User License Agreement (the “Agreement”) is a legal agreement between you (“you”) and Kir Dergachev, the developer of PauseSweep (“we”, “us”, the “Licensor”). By downloading, installing or using the PauseSweep application (the “Software”), you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.
1. License grant
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on Mac computers that you own or control, for both personal and commercial purposes (for example, editing your own videos and podcasts).
A purchased license is a one-time purchase. It may be activated on the number of devices indicated at the time of purchase. You can release (deactivate) an activation from within the app to move your license to another Mac.
2. Free trial
The Software offers a free trial of 7 days, during which all features are available. Previewing and analysing files remain free at all times; after the trial ends, saving (exporting) processed files requires a valid license. The trial is provided “as is”, with no obligation on either party to enter into a paid license.
3. Ownership
The Software is licensed, not sold. We retain all right, title and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any rights to our trademarks or branding. The files you process with the Software remain entirely yours; we claim no rights over your content.
4. Restrictions
You agree not to:
- resell, rent, lease, sublicense, distribute or otherwise transfer the Software or your license key, except as expressly permitted here;
- copy the Software except as necessary for normal use and backup;
- reverse engineer, decompile or disassemble the Software, or attempt to derive its source code, except to the extent this restriction is prohibited by applicable law;
- circumvent, disable or interfere with the trial or licensing mechanism;
- remove or alter any proprietary notices.
5. Updates
We may, but are not obligated to, provide updates, bug fixes or new versions of the Software. The Software can check for the availability of a newer version (see our Privacy Policy); it does not install updates automatically. Any update provided is governed by this Agreement unless accompanied by separate terms.
6. Purchases, payment and refunds
Purchases and license keys are handled by our payment provider, Freemius, which acts as the merchant of record. Your purchase is also subject to Freemius’ terms. Refund requests are handled in accordance with the applicable refund policy — contact us at hello@pausesweep.com and we will help.
7. Third-party software
The Software runs on Apple macOS and uses Apple’s AVFoundation frameworks. Your use of macOS is governed by Apple’s own terms. We are not responsible for third-party software or services.
8. Disclaimer of warranty
The Software is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Software will be error-free or uninterrupted, or that it will meet your requirements.
The Software edits media files. Always keep a copy of your original files. We are not responsible for any loss of, or damage to, your media.
9. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or revenue, arising out of or relating to your use of (or inability to use) the Software. Our total liability under this Agreement shall not exceed the amount you paid for the license. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; nothing in this Agreement limits rights that cannot be limited by law.
10. Term and termination
This Agreement is effective until terminated. It terminates automatically if you breach any of its terms. On termination you must stop using the Software and delete all copies. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability) will survive.
11. General
This Agreement is the entire agreement between you and us regarding the Software. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of that right. You and we will comply with all laws applicable to each of us, and will seek to resolve any dispute in good faith before pursuing other remedies.
